The counterfeit cheque was not honoured and the respondents were out of pocket the amount of their trust cheque and bank draft. They sued the Bank in negligence and conversion. At trial, the case proceeded only on the conversion allegation. The Bank counterclaimed for monies held in accounts maintained by its co-defendants.
